At Dunk Law Firm, we truly care about each and every one of our clients. We know that being involved in an unexpected accident or losing a loved one in a tragic incident is overwhelming. We're here to help.
MEET THE TEAMcontact usIn Wisconsin, drunk driving is illegal for anyone who drives any type of motor vehicle; the restrictions against drunk driving for commercial vehicle operators are particularly strict. This is because these drivers are often operating large, heavy vehicles that already pose some degree of risk to others on the road. Operating such vehicles while intoxicated (known in Wisconsin as “OWI”) is considered extremely negligent in the eyes of the law.
If you were injured or if your loved one was tragically killed in a truck accident involving a drunk truck driver, contact Dunk Law Firm right away. We can help you understand your legal rights and take swift action against the liable party. In Wisconsin, you only have three years from the date of the accident (or two years from the date of death, if your loved one died due to accident-related injuries) to bring your claim, but it is always best to take action as quickly as possible.

A commercial vehicle driver with any trace of alcohol in his or her system (a blood alcohol concentration, or BAC, of more than 0.0 percent) will have their commercial driver’s license (CDL) put “out of service” for a period of 24 hours.
If a commercial vehicle driver has a BAC between 0.4 percent and 0.8 percent, he or she will face one to three years’ CDL disqualification, along with additional fines and other penalties. If a commercial driver is arrested for a second time for operating a vehicle while intoxicated (OWI) in the state of Wisconsin, he or she will face lifetime CDL disqualification, jail time, and hundreds to thousands of dollars in fines.
If you are hit by a commercial truck driver who is intoxicated at the time of the accident, it may seem like a fairly straightforward case. However, commercial drunk driving cases are not like regular drunk driving cases. While an intoxicated truck driver can certainly be held liable for the damages he or she causes, his or her employer can also be liable for the accident under what are known as respondeat superior laws. These laws state that an employer is liable for the actions of its employees while those employees are “on the clock.”
If you were hit by or otherwise involved in a collision with an intoxicated commercial vehicle operator, you may be able to seek compensation from the driver’s employer. Our firm can help you with all aspects of your claim so that you do not have to worry about investigating the accident, establishing liability, and seeking fair compensation for your damages.
